We receive information about you from various sources, including: (i) if you register for the Online Services, through your user account for the Online Services (your “Account”); (ii) your use of the Online Services generally; and (iii) from third party websites and services. When you use the Online Services, you are consenting to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy.

 

Adizes is a U.S. company.  Regardless of the country in which you live, you authorize us to transfer, store, and use your information in the United States and in accordance with this Privacy Policy. Information Covered by Privacy Policy
This Privacy Policy covers the treatment of personally identifiable information (“Personal Information”) gathered when you are using or accessing the Online Services.  This Privacy Policy also covers our treatment of any Personal Information shared with us by third parties.  However, this Privacy Policy does not apply to the practices of third parties that we do not own or control, including but not limited to any third party websites, services and applications (“Third Party Services”) that you elect to access through the Service or to individuals that we do not manage or employ. While we attempt to facilitate access only to those Third Party Services that share our respect for your privacy, we cannot take responsibility for the content or privacy policies of those Third Party Services. We may use this information:

  • To create an Account for you on the Site;
  • To assess data about you against various internal metrics and/or analyses, including the results of psychometric evaluation(s);
  • To allow you to participate in interactive features of our services;
  • To enable us to develop and market other products and services;
  • To improve our customer service and to make our services more valuable to you, including tailoring the Site to enrich your personal online experience;
  • To send you details of reports, offers, networking events, promotions, and general information about the industry sectors in which you may be interested;
  • To comply with our legal, compliance and audit obligations, including to monitor compliance with our equal opportunities policy;
  • For surveying salary and other relevant marketplace trends;

  • A Client, to the extent your use of the Online Services is affiliated with, directed by, or requested on behalf of such Client;
  • Third parties who perform services that you or our Clients have requested, including but not limited to reference checking, background screening, psychometric evaluation, and/or skills testing; 
  • Third parties who perform services on our behalf and for us, including but not limited to professional advisors, and information technology consultants,  
  • Regulatory or law enforcement agencies, if we have a good faith belief that disclosure is required by law or is reasonably necessary to mitigate physical or financial harm, in connection with the detection or investigation of a crime, the collection of taxes, in order to comply with applicable law, legal process or court order, or in connection with legal proceedings; 
  • Other companies owned or controlled by, or under common ownership with, Adizes, including our subsidiaries (i.e. any organization we own or control).

 

Clients
If you represent a Client, we may collect, store, use and process data about you and/or or individuals in your organization including but not limited to:

  • Information about the services/products your company provides; 
  • Your company’s organizational structure; 
  • Contact information for individuals within your organization. 

 

We may collect the information from:

  • You; 
  • Third party job boards, professional forums, and similar sites; 
  • Professional associations; 
  • Survey results. 

 

We also collect certain data automatically when you visit the Site or click through any links in an email from us.  For more information, please see the section below entitled “Information Collected Using Cookies.”

 

We may disclose this information to:

  • Third parties who perform services for us, including but not limited to professional advisors, data storage and processing, document retention, and research; 
  • Other companies owned or controlled by Adizes, and other companies under common ownership as Adizes, which also includes our subsidiaries (i.e. any organization we own or control).

 

Site Users
We automatically receive and record information from your web browser when you interact with the Online Services, including your IP address and cookie information. This information may be used for fighting spam/malware and also to facilitate collection of data concerning your interaction with the Services (e.g., what links you have clicked on), provide personalized content and advertising, and remember you when you return to the Site. 

 

Account Information
When you create an Account, you will provide information that could be Personal Information, such as your name and email address. You acknowledge that this information may be personal to you, and by creating an Account for the Online Services and providing Personal Information to us, you consent to allowing others, including us, to identify you and therefore may not be anonymous. 

We may use your contact information to send you information about the Online Services, but only rarely when we feel such information is important. You may unsubscribe from these messages through your Account settings, although we, regardless, reserve the right to contact you when we believe it is necessary, such as for account recovery purposes.  Public information associated with your Account (“Profile”) includes a username, and, optionally, other information as provided by you and/or other sources.  

To the extent your use of the Online Services is affiliated with, directed by, or requested on behalf of a Client, Account and/or Profile information may be provided to us by such Client without your knowledge. 

 

User Content
Some features of the Online Services allow you to provide content to the Online Services, such as written comments. All content submitted by you to the Online Services may be retained by us indefinitely, even after you terminate your Account. We may continue to disclose such content to third parties in a manner that does not reveal Personal Information, as described in this Privacy Policy.

 

Information Collected Using Cookies
Cookies are pieces of text that may be provided to your computer through your web browser when you access a website. Your browser stores cookies in a manner associated with each website you visit. We use cookies to enable our servers to recognize your web browser and tell us how and when you visit the Site and otherwise use the Online Services through the Internet, including by enabling us to: 

  • Remember your login, recognize you when you return to the Site; 
  • Track web traffic on an aggregate basis (i.e., no individuals are identified); 
  • Track campaigns; 
  • Keep session information including but not limited to your last search.

Our cookies do not, by themselves, contain Personal Information, and we do not combine the general information collected through cookies with other Personal Information to tell us who you are. As noted, however, we do use cookies to identify that your web browser has accessed aspects of the Services and may associate that information with your Account if you have one.

 

Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. We strongly recommend that you leave cookies active, as switching off cookies will likely restrict your use of the Site. Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to “Do Not Track” signals from your browser at this time.

This Privacy Policy covers our use of cookies only and does not cover the use of cookies by third parties. We do not control when or how third parties place cookies on your computer. For example, third party websites to which a link points may set cookies on your computer.

 

Advertising and the Use of Web Beacons
To support and enhance the Online Services, we may serve advertisements, and also allow third parties’ advertisements, through the Services. These advertisements are sometimes targeted and served to particular users and may come from third party companies called “ad networks.” Ad networks include third party ad servers, ad agencies, ad technology vendors and research firms.

Advertisements served through the Online Services may be targeted to users who fit a certain general profile category and may be based on anonymized information inferred from information provided to us by a user, including Personal Information (e.g., gender or age), may be based on the Online Services usage patterns of particular users, or may be based on your activity on Third Party Services. We do not provide Personal Information to any ad networks for use outside of the Online Services.

To increase the effectiveness of ad delivery, we may deliver a file known as a “web beacon” from an ad network to you through the Online Services. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites.  Because your web browser must request these advertisements and web beacons from the ad network’s servers, these companies can view, edit or set their own cookies, just as if you had requested a web page from their site.

Aggregate Information

IP Address Information
While we collect and store IP address information, that information is not made public. We do at times, however, share this information with our partners, service providers and other persons with whom we conduct business, and as otherwise specified in this Privacy Policy.  Further, we may use this information to identify the country from which you are accessing the Site. 

 

Email Communications with Us
As part of the Online Services, you may occasionally receive email and other communications from us, such as communications relating to your Account. Communications relating to your Account will only be sent for purposes important to the Online Services, such as password recovery.

 

Profile Information
Profile information, including your username and other information you enter, may be displayed to other users to facilitate user interaction within the Online Services.  We will not directly reveal user email addresses or contact information to other users.  You may delete your username and/or other information associated with your Profile through your Account. 

 

Information Shared with Our Agents
We employ and contract with people and other entities that perform certain tasks on our behalf and who are under our control (our “Agents”).  We may need to share Personal Information with our Agents in order to provide products or services to you. Unless we tell you differently, our Agents do not have any right to use Personal Information or other information we share with them beyond what is necessary to assist us. You hereby consent to our sharing of Personal Information with our Agents.

 

Information Disclosed Pursuant to Business Transfers
In some cases, we may choose to buy or sell assets. In these types of transactions, user information is typically one of the transferred business assets. Moreover, if we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. Security of Information
Your Account information will be protected by a password for your privacy and security. You need to prevent unauthorized access to your Account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your Account.

We seek to protect Account information to ensure that it is kept private; however, we cannot guarantee the security of any Account information.  Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

We otherwise store all of our information, including your IP address information, using industry-standard techniques. We do not guarantee or warrant that such techniques will prevent unauthorized access to information about you that we store, Personal Information or otherwise.

If we become aware that your Account and/or Personal Information is or has been compromised, we will notify you promptly.

 

Where Your Personal Information Will Be Held

In order to provide the Service, the Personal Information that we collect from you may be transferred to and stored at a destination outside of your country and the European Economic Area (“EEA”), and in particular the United States. It may also be processed by any service providers appointed by us who operate outside of the EEA and their staff. By submitting your data, you agree to this transfer, storing or processing outside of the EEA or your country and acknowledge that not all countries guarantee the same level of protection for your Information as the one in which you reside. Data transferred will be treated in accordance with this Policy and, where applicable, the EU’s GDPR.

Rights for California Residents

If you are a California Consumer, you have certain rights with respect to the collection, use, transfer, and processing of your personal information, as defined by the California Consumer Privacy Act (CCPA) (“PI”). We reserve the right to limit these rights where permitted under applicable law, including where your identity cannot be reasonably verified or to the extent your rights adversely affect the rights and freedoms of others. Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your PI.

Under the CCPA, if you are a California resident you are entitled to a list of the categories of PI that we have collected about consumers in the last 12 months, the business or commercial purpose(s) for which that information will be used, the categories of sources from which that information was collected and the categories of third parties with whom we share that information. That information is provided in the table below.

Under the CCPA, you are also entitled to request that we disclose the categories of PI that we have collected about you in the prior twelve months, that we disclose the categories of sources from which that information was collected, that we disclose the business or commercial purpose for collecting or selling that information, that we disclose the specific pieces of PI that we have collected about you, and/or that we delete your PI.

If you wish to make a request under the CCPA, you may do so by calling us at +1 805 566-0742 and providing the following information: name, address, cell phone number and email address, and specifying your request under the CCPA.  We use this information solely to verify your request. We may follow up with you by telephone if additional information is necessary to verify your request. Upon verification, we will endeavor to respond to you within 45 days of receiving your request. If you are an authorized agent of a California resident and wish to make a request under the CCPA for that California resident, you may make a request by calling as at +1 805 566-0742 and providing the same information described above for both you and the California resident for whom you are the authorized agent. We will follow up with you by telephone to request appropriate written authorization confirming that you are authorized to make the request on behalf of the California resident. 

Under the CCPA, you are also entitled to request that we disclose the categories of PI that we sold about you in the prior twelve months, the categories of third parties to whom that information was sold (by category of PI for each such third party), and the categories of PI that we disclosed about you for a business purpose.

The CCPA also protects you from discrimination because you exercised any of your rights under the CCPA 

Lastly, the CCPA requires us to state whether we sell the Personal Information of minors under 16 years of age without affirmative authorization. We do not intentionally collect such information, and to the extent we do, we do not sell it.

Deleting your Account
Should you ever decide to delete your Account, you may do so through the settings of your Account itself, or by emailing contact@adizes.com. Please note that we will need to verify that you have the authority to delete the Account.  

If you terminate your Account, any association between your Account and information we store will no longer be accessible through your Account.  However, Activity generated prior to deletion will remain stored by us, and any public activity on your Account prior to deletion may remain publicly accessible.

Further, to the extent that your use of the Online Services is affiliated with, directed by, or requested on behalf of a Client, information from your Account may still be provided to such Client with or without notice to you, notwithstanding the deletion of your Account.

 

Choices Regarding Your Information
You may opt not to disclose certain information to us, even though it may be needed to take advantage of some of the Site features.  However, this is subject to any conditions, requirements, or obligations on you imposed by a Client with whom you have an existing relationship with respect to use of the Online Services.  The terms of your rights and choices regarding the Online Services as they pertain to your relationship with such Client is not within the purview of this Privacy Policy.  

We are not responsible for the outcomes that may result from your use of the Online Services, or from our disclosure of your Personal Information to other parties subject to the terms of this Privacy Policy.

 

Changes to This Privacy Policy

We reserve the right to modify or update this Privacy Policy at any time, consistent with legal, contractual, and regulatory requirements.  Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used.  If we make changes in the way we collect or use information that, in our sole discretion, is material, we will notify you by posting an announcement on the Online Services or sending you an email.  By continuing to access or use the Online Services after those changes become effective, you agree to be bound by any changes to the Privacy Policy.
